Our Commitment to Your Privacy: Your privacy is important to Avista Capital Partners and its affiliates (“Avista” or the “Firm”). Avista has a policy of protecting the confidentiality and security of information we collect about you. Avista owns and operates this site (“Site”). We are providing you with this Website Privacy Policy (“Policy”) , to help you understand the types of information Avista collects through our Site, how we will use, disclose and protect this information once it is collected, and how you can opt-out of some of these practices.

This Policy together with our website Terms of Use, Avista Privacy Policy and Avista EU Privacy Notice, set the basis on which Avista processes personal data. Please read the following carefully to understand our views and practices regarding how Avista handles personal data.

This Policy does not apply to:

  • Information that you may provide, or that Avista may obtain, through your account hosted by FIS Data Exchange. Such information is subject to the FIS Privacy Policy available on its Website (http://www.sungarddx.com/Privacy-Policy.html) which we encourage you to read to learn about the treatment of such information.
  • “Nonpublic personal information” (as defined by the Gramm-Leach-Bliley Act) about individuals who have obtained a financial product or service from us that is to be used primarily for personal, family or household purposes. Such information is subject to the privacy notices that Avista provide to such individuals pursuant to the Gramm-Leach Bliley Act and applicable regulations promulgated thereunder.
  • Information that you may provide to us, or that we may obtain, other than through the Site, such as over the phone, by mail, by email or in person.

If you are located outside of the United States, you should know that certain information collected about you is being transmitted to us and processed in the United States and will be protected subject to this Policy and United States laws, which may not be as protective as the laws in your country. Also, through the Site, our service providers may place cookies on your computer or device and use other tracking technologies which are further described below.

What information is collected on this Site?
Avista utilizes Google Analytics Solutions for our web analytics. You can opt out of your Site usage data being included in our Google Analytics reports by visiting https://tools.google.com/dlpage/gaoptout.

As is the case with many Websites, our service providers may automatically collect your IP address when you visit our Site, and may associate that with your domain name or that of your Internet access provider. Our service providers may also capture certain “clickstream data” pertaining to your Site usage. Clickstream data includes, for example, information about your computer or device, Web browser and operating system and their settings, the referring page that linked you to the Site, the pages, content you see or click on during your visit and when and for how long you do so, items you download, the next Website you visit when you leave the Site, and any search terms you have entered on the Site or a referral site.

How is your information used?

Do we share your information with others?

Do Not Track Disclosures
Some web browsers may transmit “do-not-track” (DNT) signals to the websites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them.

Our third party web analytics service provider, Google, may collect information about your online activities over time and across our Site and other online properties. Google may not change its tracking practices in response to DNT settings in your web browser, and we do not obligate it to honor DNT settings. If you have an account hosted by FIS Data Exchange which you may be able to access by following a hyperlink on the Site, please refer to the FIS Privacy Policy to understand your rights to review, update or modify certain of the personally identifiable information that is stored in that account.

Security
Due to the inherent nature of the Internet as an open global communications vehicle, we cannot guarantee that any information, during transmission through the Internet or while stored on our system or otherwise in our care, will be absolutely safe from intrusion by others, such as hackers. A third party could view the information you send in transit by electronic means. We will have no liability for disclosure of your information due to errors or unauthorized acts of third parties during or after transmission.

“Linked-To” Websites
The Site may contain links, banners or widgets that lead to other Websites, including to your account, if applicable, with Intralinks, Inc. or another third party. We are not responsible for these other sites and their posted privacy policies (not this Policy) will govern the collection and use of your information on them. We encourage you to read the privacy statements of each Website visited after leaving the Site to learn about how your information is treated by others.

Changes to this Privacy Policy
Avista may change this Policy from time to time. When we do, we will let you know by posting the changed Policy on this page, and where appropriate, notify to you by e-mail.
